Alt Text Generator Terms of Service
Effective as of 2.11.2026.
1. General Provisions
1.1. These Terms and Conditions (hereinafter: the “Terms”) define the rules for the electronic provision of the alt text generator service (hereinafter: the “Generator” or the “Service”) by DOCK sp. z o.o. with its registered office in Gdańsk, ul. Wały Piastowskie 1/1508, 80-855 Gdańsk, Poland, entered into the Register of Entrepreneurs of the National Court Register maintained by the District Court Gdańsk-Północ in Gdańsk, 7th Commercial Division, under KRS number 0001105135, NIP 9571173402, REGON 528630778 (hereinafter: the “Service Provider”).
1.2. The Service is provided through the DockAccess Service available at https://dockaccess.org (hereinafter: the “Website”), the API, and the plugins and integration libraries provided by the Service Provider.
1.3. These Terms supplement the DockAccess Store Terms of Service, which set out the rules for placing orders, payments and keeping an Account. In matters concerning the Generator, these Terms prevail. The processing of personal data by the Service Provider as a controller is governed by the Privacy Policy.
1.4. Starting to use the Generator, in particular uploading the first Image, constitutes acceptance of these Terms.
1.5. Contact with the Service Provider: contact@dockaccess.org.
2. Definitions
3. Description of the Service
3.1. The Generator creates proposed Alt Texts for Images using an artificial intelligence model of an external provider (on the effective date of these Terms: Google, the Gemini model). For one Image the Generator may prepare up to 5 variants.
3.2. The User may review, edit, select and regenerate Alt Texts in the Account or in the Integration’s panel. The Integration saves the selected texts in the User’s CMS.
3.3. The Generator tool on the Website can be used to a limited extent without an Account. The Guest limit is daily and counted per IP address.
3.4. The Service Provider may change the artificial intelligence model, its provider, the supported file formats and the way the Generator works, provided this does not materially impair the core function of the Service paid for by the Client.
4. Plans and Limits
4.1. The Generator is available on a free plan and on paid plans. On the effective date of these Terms the following limits apply:
| Plan | Generation limit | Limit period | Number of Sites |
|---|---|---|---|
| Free (Account) | 10 | day | 1 |
| Starter | 500 | calendar month | 3 |
| Pro | 2,000 | calendar month | 10 |
| Agency | 20,000 | calendar month | 100 |
4.2. Current limits and prices are set out in the Pricing. In case of discrepancies, the limits shown in the Pricing and in the Account at the time the contract is concluded or the subscription is renewed prevail.
4.3. Each generation of Alt Texts for one Image, including a repeated generation requested by the User, uses one unit of the Limit, regardless of the number of variants. Editing an Alt Text manually does not use the Limit.
4.4. A daily Limit renews at midnight UTC and a monthly Limit on the first day of the calendar month (UTC). An unused Limit does not carry over to the next period and is not refunded or settled.
4.5. A monthly Limit can be used at any time within the month, including in a single day. Once the Limit is used up, the Generator does not create new Alt Texts until it renews or the plan is upgraded. Texts generated earlier remain available.
4.6. The number of Sites for which the Generator can be enabled follows from the plan. If the accessibility widget plan provides for more Sites, the higher value applies.
4.7. To keep the Service stable, the Service Provider may apply technical limits on the number of requests per unit of time and on the size and number of files sent at once.
5. Technical Requirements
Using the Generator requires:
6. User Obligations
6.1. The User represents that they hold the rights to the Images and context they send and that sending them to the Generator and their processing by the artificial intelligence model provider does not infringe the rights of third parties or the law.
6.2. Sending unlawful content is prohibited, in particular content depicting the sexual abuse of minors, terrorist content, content inciting hatred or violence, content infringing copyright or personal rights, and files containing malware.
6.3. The User does not send Images containing personal data, in particular special categories of data (Article 9 GDPR), identity documents or financial data, unless the Image is published on the Site, describing it is necessary and the User has a legal basis for such processing.
6.4. The User may not:
6.5. The User is responsible for installing, configuring and updating Integrations according to the documentation and for securing access credentials.
7. Nature of Results and Duty to Review
7.1. Alt Texts are created automatically by an artificial intelligence model and are proposals. They may be imprecise, incomplete, unsuited to the context of the Site, contain factual or language errors, or inappropriate content.
7.2. Before publication, the User reviews each Alt Text and corrects it where necessary. In particular, the User decides whether an Image is decorative and should have an empty alt attribute, and whether the description discloses personal data or confidential information.
7.3. The User is responsible for the content published on the Site, including Alt Texts saved in the CMS by an Integration (also automatically, if the User has enabled such an option).
7.4. The Service Provider does not guarantee that Alt Texts meet WCAG success criterion 1.1.1 or other requirements of accessibility law. Using the Generator does not replace an accessibility audit.
7.5. Similar Images may receive similar or identical Alt Texts, including for other Users.
8. Rights to Content
8.1. The User retains all rights to the Images and the context sent. To the extent necessary to provide the Service, the User grants the Service Provider a free, non-exclusive licence to store the Images, reproduce them in computer memory, process them, send them to the artificial intelligence model provider and display them in the Account and the Integration, for as long as the Images are stored in the Generator, with the right to grant sublicences to the Service Provider’s subcontractors to the same extent.
8.2. The Service Provider claims no rights to the Alt Texts generated for the User. The User may use them without restriction, including modifying and publishing them.
8.3. The Service Provider does not use the User’s Images or Alt Texts to train artificial intelligence models. It may use anonymised, aggregated statistics on the use of the Service (e.g. the number of generations, response times) to develop it and to keep it secure.
8.4. The software of the Generator and the Website and the documentation are protected by copyright and belong to the Service Provider. The User uses Integrations under the licence stated in their documentation or installation package.
9. Storage and Deletion of Data
9.1. Images and Alt Texts of a User with an Account are stored for as long as the Service is used, so that they can be reviewed, edited and regenerated.
9.2. Images sent by Guests are deleted after 14 days.
9.3. Images deleted by the User are permanently deleted within 30 days. Backups may be kept longer, in line with their rotation cycle.
9.4. After the contract ends or the Account is deleted, the Service Provider may delete the Images and Alt Texts. Texts saved earlier in the User’s CMS remain there. The Generator is not an archiving service; the User keeps the original Images in their own systems.
10. Personal Data
10.1. The Service Provider is the controller of the Users’ personal data (Account, contact and billing data), as described in the Privacy Policy.
10.2. Where Images or context contain personal data of third parties (e.g. a person’s image), the User is their controller and the Service Provider processes them on the User’s behalf as a processor. To that extent, upon acceptance of these Terms the parties conclude a data processing agreement within the meaning of Article 28 GDPR on the following terms:
11. Availability of the Service and Support
11.1. The Service operates in the SaaS model. The Service Provider makes efforts to keep it available continuously but does not guarantee uninterrupted operation. Interruptions may occur due to maintenance, updates, failure recovery or unavailability of the artificial intelligence model provider.
11.2. The SLA does not cover the Generator unless the parties agree otherwise in documentary form.
11.3. Technical support is provided electronically at contact@dockaccess.org on business days from 9:00 to 17:00 CET. Programming and implementation work on the User’s side is an additional paid service.
12. Suspension and Termination
12.1. The Service Provider may suspend access to the Generator or block an API key if the User breaches these Terms, in particular section 6, or if the security of the Service so requires. The Service Provider informs the User of the suspension and its reason, unless this is not possible or is prohibited by law.
12.2. In the event of a serious or repeated breach of these Terms, the Service Provider may terminate the contract with immediate effect. The fee for the current billing period is then not refunded.
12.3. The Client may cancel the renewal of the subscription in the Account. The paid plan remains active until the end of the paid period, after which the Account uses the Limits of the free plan. The User may stop using the Service and delete the Account at any time.
12.4. The Service Provider may discontinue the free plan with 30 days’ notice, given by e-mail or in the Account.
13. Liability
13.1. The Service Provider is not liable for:
13.2. The Service Provider’s total liability towards the Client under the contract for the Service is limited to the net fee paid for the Service in the billing period in which the damage occurred and does not cover lost profits. On the free plan, the Service Provider is not liable for damage, except for damage caused intentionally.
13.3. The limitations of liability do not apply to damage caused intentionally.
13.4. A User who is a business indemnifies the Service Provider against liability towards third parties and covers reasonable costs, including legal costs, related to claims resulting from the User’s breach of section 6.
14. Complaints
14.1. Complaints regarding the Generator may be sent to contact@dockaccess.org. A complaint should include the Account e-mail address, the Site address, a description of the problem and when it occurred.
14.2. The Service Provider reviews a complaint within 14 days of receipt and replies by e-mail.
14.3. If a complaint is upheld, the Service Provider may in particular regenerate Alt Texts without using the Limit, restore the used Limit or offer another form of compensation.
15. Changes to the Terms and Final Provisions
15.1. The Service Provider may amend these Terms for valid reasons, in particular a change in the law, a change in the features or scope of the Service, a change of the artificial intelligence model provider, security reasons or a change in the Pricing.
15.2. Users with an Account are informed of a change to these Terms by e-mail or in the Account at least 14 days before it takes effect. A Client who does not accept the changes may, before that date, cancel the renewal of the subscription or terminate the contract with effect from the date the changes take effect. Continued use of the Service after that date constitutes acceptance of the changes.
15.3. The contract is governed by Polish law. Disputes with Users who are businesses are resolved by the court competent for the Service Provider’s registered office.
15.4. Provisions of these Terms limiting the Service Provider’s liability or the User’s rights do not apply to consumers or to natural persons concluding a contract directly related to their business where the contract is not of a professional nature for them, to the extent they would contravene mandatory provisions of law.
15.5. The invalidity of any provision of these Terms does not affect the validity of the remaining provisions.
