Accessibility Statement Generator Terms of Service
Effective as of 2.11.2026.
1. General Provisions
1.1. These Terms and Conditions (hereinafter: the “Terms”) define the rules for the electronic provision of the accessibility statement generator service (hereinafter: the “Generator” or the “Service”) by DOCK sp. z o.o. with its registered office in Gdańsk, ul. Wały Piastowskie 1/1508, 80-855 Gdańsk, Poland, entered into the Register of Entrepreneurs of the National Court Register maintained by the District Court Gdańsk-Północ in Gdańsk, 7th Commercial Division, under KRS number 0001105135, NIP 9571173402, REGON 528630778 (hereinafter: the “Service Provider”).
1.2. The Service is provided through the DockAccess Service available at https://dockaccess.org (hereinafter: the “Website”).
1.3. These Terms supplement the DockAccess Store Terms of Service, which set out the rules for placing orders, payments and keeping an Account. In matters concerning the Generator, these Terms prevail. The processing of personal data by the Service Provider as a controller is governed by the Privacy Policy.
1.4. Starting to use the Generator, in particular entering the address of a Site or creating a Document in manual mode, constitutes acceptance of these Terms.
1.5. Contact with the Service Provider: contact@dockaccess.org.
2. Definitions
3. Description of the Service
3.1. In automatic mode, based on the address of a Site, the Generator:
3.2. To find data, select subpages and classify, the Generator may use an artificial intelligence model of an external provider (on the effective date of these Terms: Google, the Gemini model) and automatic rules. A Document field filled in automatically shows its source, and fields with lower confidence require confirmation by the User.
3.3. In manual mode, the User fills in the Document themselves, without a scan of the Site.
3.4. The Generator only fetches publicly available pages. It does not sign in, does not fill in forms and skips cart, order, account and back-office pages. The number of fetches per Generation is limited.
3.5. The Generator provides templates: for Polish public bodies, an accessibility statement in the structure set by the Polish minister responsible for digitisation; for Polish businesses, information on how the service meets accessibility requirements; and for other entities, a general template based on Commission Implementing Decision (EU) 2018/1523, with additions for selected countries. In some countries an official tool or form is mandatory; the Document from the Generator is then a draft.
3.6. The User may approve a Document, download or copy its HTML code, or embed it on the Site in an iframe. A Document embedded in an iframe is available at a public address on the Website to anyone who knows that address and shows the latest approved version.
3.7. Depending on the plan, the Generator sends reminders to review the Document and allows the DockAccess logo to be removed from the iframe.
3.8. At the User’s request, the Service Provider’s team may correct a Document. Changes and approvals made by a staff member are recorded in the Document’s history. Responsibility for the content of the Document remains with the User.
3.9. The Service Provider may change the templates, the artificial intelligence model and the way the Generator works, in particular following changes in laws or guidelines.
4. Plans and Limits
4.1. The Generator is available on a free plan and on paid plans. On the effective date of these Terms the following limits and features apply:
| Plan | Generations per month | Review reminders | Iframe without the DockAccess logo |
|---|---|---|---|
| Free (including Guests) | 2 | no | no |
| Starter | 10 | yes | no |
| Pro | 20 | yes | yes |
| Agency | 100 | yes | yes |
4.2. Current limits, features and prices are set out in the Pricing. In case of discrepancies, the values shown in the Pricing and in the Account at the time the contract is concluded or the subscription is renewed prevail.
4.3. Only a Generation that completes with a result uses the Limit. A Generation in progress reserves one unit of the Limit and a failed Generation releases it. Manual mode, editing, approval and Publication do not use the Limit.
4.4. The Limit renews on the first day of the calendar month. An unused Limit does not carry over to the next month and is not refunded or settled.
4.5. The Guest limit is counted per hashed IP address. Before a Generation starts, the Service Provider may require a check against automated use (reCAPTCHA).
4.6. After a paid plan ends, Documents remain available at the same address. Plan-dependent features (reminders, hiding the logo) stop working and the DockAccess logo returns to the iframe.
5. Technical Requirements
Using the Generator requires:
6. User Obligations
6.1. The User enters the address of a Site they run or for which they are authorised to prepare a Document by the entity running it. Using the Generator to scan websites without such authorisation or in a way that burdens their infrastructure is prohibited.
6.2. The User is responsible for the truthfulness, completeness and timeliness of the data in the Document, both entered manually and proposed automatically and then confirmed or left in the Document.
6.3. Before Publication, the User checks in particular: the type of entity and the laws that apply to it, the chosen type of Document, the compliance status, the list of inaccessible content and the justification of exemptions, the contact details, the procedure for requests and complaints, and the dates of preparation, publication and review.
6.4. If the Document contains data of natural persons (e.g. the name, e-mail address or phone number of a contact person), the User ensures a legal basis for publishing it and informs those persons about the processing.
6.5. The User is responsible for placing the Document on the Site as required by law and for reviewing and updating it regularly. The Generator’s reminders are only an aid.
6.6. The User may not:
7. Nature of the Document and Results
7.1. The Generator is an auxiliary tool. A Document prepared by the Generator is a draft for the User to verify and does not constitute legal advice, a legal opinion or confirmation that the Site complies with the law or with WCAG.
7.2. The automatic scan covers only some WCAG criteria, the home page and a limited number of subpages, and its results may contain errors, both false positives and omissions. The accessibility status stated in the Document should result from an analysis of the whole Site, including manual tests or a manual audit.
7.3. Organisation data found automatically may be outdated, incomplete or wrongly attributed. It shows its source and must be checked by the User.
7.4. The templates and texts of the Document reflect the legal situation known to the Service Provider when they were prepared. The Service Provider does not guarantee that they cover all national requirements or later changes in laws or guidelines.
7.5. The content of the Document in languages other than Polish and English was prepared with machine translation. The Service Provider recommends having it checked by a person who knows the language.
7.6. Determining whether and which accessibility obligations apply to an entity, and choosing the type of Document, is the User’s responsibility. The Service Provider offers manual audits and consulting as separate, paid services.
8. Rights to Content
8.1. The User may use the Documents prepared in the Generator, including the template elements they contain, without time limit, to publish, change and update them for the Site they concern, also after the contract ends.
8.2. Document templates, layouts, the iframe code and the Generator’s software are protected by copyright and belong to the Service Provider. Using them for purposes other than those in section 8.1, in particular reselling the templates, is prohibited.
8.3. The User authorises the Service Provider to store the Document and make it available at a public address on the Website to the extent chosen by the User and, unless the plan includes removing the logo, to display the DockAccess mark with a link to the Website next to it.
8.4. The Service Provider does not use the content of Documents to train artificial intelligence models. It may use anonymised, aggregated statistics on the use of the Service to develop it and to keep it secure.
9. Storage, Publication and Deletion
9.1. Documents of a User with an Account are stored for as long as the Service is used, together with the history of approved versions, scan results and data sources.
9.2. A Guest’s Document is linked to a token saved in the Guest’s browser. Losing the token (e.g. after clearing browser data) means losing access to the Document, and the Service Provider does not restore such access. After signing in, a Guest’s Document can be attached to an Account. The Service Provider may delete Guest Documents not attached to an Account 90 days after their last change.
9.3. Deleting a Document by the User disables its public address, and the Site stops showing a Document embedded in an iframe. The Service Provider may keep deleted Documents to the extent necessary for evidence and security purposes.
9.4. After the contract ends or the Account is deleted, the Service Provider may stop serving Documents in iframes. The User should keep a copy of the Document in HTML and, if needed, publish it directly on the Site.
10. Personal Data
10.1. The Service Provider is the controller of the Users’ personal data (Account, contact and billing data), as described in the Privacy Policy.
10.2. For personal data contained in Documents and fetched from the Site during a Generation (e.g. data of contact persons, accessibility coordinators or persons named on contact pages), the controller is the User or the entity on whose behalf the User acts, and the Service Provider processes that data on its behalf as a processor. To that extent, upon acceptance of these Terms the parties conclude a data processing agreement within the meaning of Article 28 GDPR on the following terms:
11. Availability of the Service and Support
11.1. The Service operates in the SaaS model. The Service Provider makes efforts to keep the Generator and the public addresses of Documents available continuously but does not guarantee uninterrupted operation. Interruptions may occur due to maintenance, updates, failure recovery or unavailability of external providers.
11.2. The SLA does not cover the Generator unless the parties agree otherwise in documentary form.
11.3. Technical support is provided electronically at contact@dockaccess.org on business days from 9:00 to 17:00 CET.
12. Suspension and Termination
12.1. The Service Provider may suspend access to the Generator, withhold the Publication of a Document or delete a Document if the User breaches these Terms, in particular section 6, if the Document contains unlawful content, or if the security of the Service so requires. The Service Provider informs the User of the suspension and its reason, unless this is not possible or is prohibited by law.
12.2. In the event of a serious or repeated breach of these Terms, the Service Provider may terminate the contract with immediate effect. The fee for the current billing period is then not refunded.
12.3. The Client may cancel the renewal of the subscription in the Account. The paid plan remains active until the end of the paid period, after which the Account uses the free plan. The User may stop using the Service and delete Documents and the Account at any time.
12.4. The Service Provider may discontinue the free plan with 30 days’ notice, given by e-mail or in the Account.
13. Liability
13.1. The Service Provider is not liable for:
13.2. The Service Provider’s total liability towards the Client under the contract for the Service is limited to the net fee paid for the Service in the billing period in which the damage occurred and does not cover lost profits. On the free plan, the Service Provider is not liable for damage, except for damage caused intentionally.
13.3. The limitations of liability do not apply to damage caused intentionally.
13.4. A User who is a business indemnifies the Service Provider against liability towards third parties and covers reasonable costs, including legal costs, related to claims resulting from the User’s breach of section 6.
14. Complaints
14.1. Complaints regarding the Generator may be sent to contact@dockaccess.org. A complaint should include the Account e-mail address or the Document’s address, a description of the problem and when it occurred.
14.2. The Service Provider reviews a complaint within 14 days of receipt and replies by e-mail.
14.3. If a complaint is upheld, the Service Provider may in particular restore the used Limit, correct the Document or offer another form of compensation.
15. Changes to the Terms and Final Provisions
15.1. The Service Provider may amend these Terms for valid reasons, in particular a change in the law, a change in the features or scope of the Service, a change of the artificial intelligence model provider, security reasons or a change in the Pricing.
15.2. Users with an Account are informed of a change to these Terms by e-mail or in the Account at least 14 days before it takes effect. A Client who does not accept the changes may, before that date, cancel the renewal of the subscription or terminate the contract with effect from the date the changes take effect. Continued use of the Service after that date constitutes acceptance of the changes.
15.3. The contract is governed by Polish law. Disputes with Users who are businesses are resolved by the court competent for the Service Provider’s registered office.
15.4. Provisions of these Terms limiting the Service Provider’s liability or the User’s rights do not apply to consumers or to natural persons concluding a contract directly related to their business where the contract is not of a professional nature for them, to the extent they would contravene mandatory provisions of law.
15.5. The invalidity of any provision of these Terms does not affect the validity of the remaining provisions.
